1. Acceptance of Terms

By accessing or using the Hamio Market mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Hamio Market is a peer-to-peer local marketplace platform that connects buyers and sellers within neighborhoods in Nepal. The Service provides:

  • Product listing and browsing
  • In-app messaging with text, image, and voice memo support
  • Local community feeds and groups
  • Neighborhood-based discovery

3. Platform Role and Limitations

Hamio Market is an information matching platform only. We do not:

  • Process payments or handle financial transactions between users
  • Guarantee the quality, safety, legality, or availability of listed items
  • Verify the identity or background of users beyond phone number verification
  • Mediate or resolve disputes between buyers and sellers
  • Take possession of, store, or ship any items

All transactions are conducted directly between users at their own risk. Supported payment methods (cash, bank transfer, eSewa, Khalti) are arranged directly between the parties involved.

4. Account Registration

  • You must be at least 16 years old to create an account.
  • You must provide a valid phone number for WhatsApp OTP verification.
  • You are responsible for maintaining the security of your account.
  • You may not create multiple accounts or impersonate others.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Prohibited Items and Conduct

5.1 Prohibited Items

The following items may not be listed or traded on Hamio Market:

  • Beef and beef products — Prohibited under Nepalese law. Listings will be removed immediately.
  • Controlled substances and illegal drugs
  • Weapons, firearms, and ammunition
  • Counterfeit or stolen goods
  • Hazardous materials
  • Human remains or body parts
  • Items that violate intellectual property rights

5.2 Restricted Items

The following items require additional warnings or restrictions:

  • Pork and pork products — Allowed with a religious sensitivity warning displayed to users.
  • Alcohol — Allowed only with valid licensing verification.

5.3 Prohibited Conduct

  • Fraud, scams, or deceptive practices
  • Harassment, hate speech, or discrimination
  • Spam or unsolicited advertising
  • Misrepresenting item condition, price, or availability
  • Manipulating the reputation or review system
  • Using the Service for any illegal purpose

6. User Content

You retain ownership of content you post (listings, messages, voice memos, community posts). By posting content, you grant Hamio Market a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service.

You are solely responsible for the content you post. We may remove content that violates these Terms without prior notice.

7. Voice Messages

The Service includes a voice messaging feature. By using this feature:

  • You consent to your voice being recorded and transmitted to other users.
  • Voice recordings are limited to 60 seconds per message.
  • Voice messages are stored on our servers and subject to our Privacy Policy.
  • You must not use voice messages to harass, threaten, or intimidate others.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Items listed are accurately described or legally available
  • Transactions between users will be completed satisfactorily
  • Users are who they claim to be

9. Limitation of Liability

To the maximum extent permitted by Nepalese law, Hamio Market shall not be liable for:

  • Any loss or damage arising from transactions between users
  • The quality, safety, or legality of items listed on the platform
  • Any disputes between buyers and sellers
  • Loss of data or unauthorized access to your account
  • Any indirect, incidental, or consequential damages

10. Indemnification

You agree to indemnify and hold harmless Hamio Market, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal.
